"Tom Brady is fighting back. The Patriots quarterback plans to appeal for a second hearing with the 2nd US Circuit Court of Appeals over his four-game Deflategate suspension being imposed by the NFL, according to multiple reports. Monday was the final day that Brady had to file appeal after the ban was upheld last month. 'The facts here are so drastic and so apparent that the court should rehear it,' NFL Players Association attorney Theodore B. Olson told 'Good Morning America' on Monday. Brady is appealing for an en banc hearing, and now all 13 active judges in the Second Circuit court must decide if the appeal has merit and deserves to be re-heard. If at least seven agree that it does, the case will be heard in front of the entire roster of active judges. According to the Boston Globe, it is exceedingly rare for the Second Circuit to accept en banc appeals: Between 2000-10, only eight of 27,856 appeals (less than .03 percent)", nypost.com
