"Less than two weeks before the biggest track meet of his life, U.S. Olympic hopeful Boris Berian remains in sneaker limbo. U.S. District Court Judge Marco Hernandez declined to rule Wednesday on whether Nike or New Balance have the right to outfit the up-and-coming 800 runner. Nike took the highly unusual step of suing one of its athletes when Berian notified the Beaverton company in January he was opting for New Balance instead. In a highly charged case that has attracted the close scrutiny of elite athletes, agents and coaches, Nike claimed it would suffer 'irreparable harm' if it loses Berian. Berian has said repeatedly that with his Nike contract expiring he had every right to sign with New Balance, whose shoes he prefers. The specter of a $30 billion-a-year company dragging a potential star of the U.S. Olympic team through a distracting court fight in the months and weeks leading up to the Olympic Trials and Summer Olympics has angered some track and field", www.oregonlive.com
"UPDATE: Late on June 23, Nike dropped their breach of contract suit against Boris Berian, not because they were wrong or because the bad PR had reached toxic levels, but as a consideration of the stress the suit was causing Berian. Or Boris, as the congenial Nike spokesperson likes to call him.", fittish.deadspin.com
"Nike has dropped its controversial lawsuit against American runner Boris Berian. A day after saying in federal court it would suffer 'irreparable harm' if it allowed Berian to leave Nike and go instead to New Balance, Nike without elaboration filed a notice of voluntary dismissal late Thursday. U.S. District Judge Marco Hernandez was set to rule next week on Nike's request for a preliminary injunction forbidding Berian from going to New Balance. It was clear from his questions in court Wednesday that the judge had his doubts about Nike's contention that it had matched New Balance's offer. The case earned Nike withering criticism from parts of the elite track and field crowd who argued it was unfair for the giant Beaverton company to haul Berian into court on the eve of a potentially career-making series of competitions this summer at the Olympic Trials and the Summer Olympic Games in Brazil. In a statement, the company said it continues to believe it would win", www.oregonlive.com
"From Yahoo Sports: US world indoor 800m champion Boris Berian's Olympics preparations have been thrown into turmoil after a legal victory for Nike in the latest twist to an increasingly acrimonious contract dispute. Merhawi Keflezighi, who represents Berian, one of the stars of the recent World Indoor Championships in Portland, confirmed Nike had successfully gained a temporary restraining order preventing Berian from racing in non-Nike gear. 'Nike is suing Boris Berian in order to keep him from signing an endorsement contract with another footwear company,' Keflezighi said.", sports.yahoo.com
